Purpose and scope of the Policy

ECO-INNOV, a subsidiary of the GROUPE RAGNI, attaches the utmost importance and care to the protection of privacy and personal data, as well as to compliance with the provisions of applicable legislation.

Regulation (EU) 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter “RGPD”) affirms that personal data must be processed lawfully, fairly and transparently. Accordingly, this data protection policy (hereinafter the “Policy”) aims to provide you with simple, clear information on the processing of personal data concerning you, particularly in the context of your browsing and operations carried out on our website.

The person responsible for processing your personal data

The person responsible for processing your personal data, within the meaning of the applicable regulations on the protection of personal data and in particular the RGPD is ECO-INNOV Société par Actions Simplifiée with capital of 30,000 euros, whose registered office is located at 523 rue de la Béalière, 38360 Noyarey.

Why do we collect your personal data?

This Policy applies to the collection and processing of your personal data, for specific purposes and on different legal grounds.

In the context of contract performance or pre-contractual measures, your data is processed for the following purposes:

• Quotation management ;
• Order management, purchasing ;
• Management of contracts with customers/suppliers ;
• Claims and after-sales service management.

On the basis of your consent, your data will be processed for the following purposes:

• Management of cookies requiring your consent (cookies used for audience analysis).

In the context of ECO-INNOV’s legitimate interests, your data is processed for the following purposes:

• Managing requests for information ;
• Communications management ;
• Prospect/customer relationship management ;
• Commercial event management ;
• Management of the proper functioning and continuous improvement of the site (through technical cookies);
• Pre-litigation and litigation management.

Within the framework of the legal and regulatory obligations to which ECO-INNOV is subject, your data are processed for the following purposes:

• General and subsidiary accounting ;
• Manage your personal data rights.

The personal data we collect about you

Personal data is processed in compliance with the principle of minimization imposed by the RGPD. The nature and quality of personal data processed varies according to the relationship you have with ECO-INNOV, the main ones of which are:

• Identification data: this includes any information that would enable us to identify you, such as your surname, first name and telephone number. We may also collect your e-mail address, as well as your postal address (in the event of payment, the postal address will be required to generate an invoice).
• Financial data: this corresponds to bank details such as a bank details form.
• Browsing information: when you browse our website, you interact with it. As a result, certain information relating to your browsing is collected.
• Data collected from our network of sales agents/distributors: our network of agents/distributors is responsible for sales prospecting and day-to-day relationship management. In the course of their work, these agents may collect some of your personal data, such as your contact details (surname, first name, e-mail address, telephone number), as well as information relating to your needs or commercial interests. This information is then transmitted to ECO-INNOV to ensure the continuity of the commercial relationship and the follow-up of your requests.

Recipients of your personal data

Your data will be used by authorized ECO-INNOV employees in charge of managing and executing contracts and legal obligations, depending on the purpose of the data collection and within the limits of their respective responsibilities.

It may be transmitted to the following recipients for certain tasks related to the purposes, and within the limits of their respective missions and authorizations:

• Entities of the GROUPE RAGNI in the context of outsourcing an activity to another entity of the group (in particular the sending of communications);
• Our network of sales agents/distributors ;
• Service providers we use to carry out a set of operations and tasks on our behalf:
  Order transport management
  Website audience analysis
  Data hosting
  Sales prospecting
  After-sales service management
• Duly authorized public authorities (judicial, supervisory, etc.), as part of our legal and regulatory obligations;
• Regulated professions (lawyers, bailiffs, etc.) who may be involved in the implementation of guarantees, collection or litigation;

When your data is communicated to our service providers, we also ask them not to use the data for purposes other than those originally intended. We make every effort to ensure that these third parties maintain the confidentiality and security of your data.

In all cases, only the necessary data is provided. We make every effort to ensure secure communication and transmission of your data.

We do not sell your Data.

Transferring your data to third countries

ECO-INNOV endeavors to store personal data in France, or at least within the European Economic Area (EEA).

However, it is possible that the data we collect when you use our site or our services may be transferred to other countries. This is the case, for example, if some of our service providers are located outside the European Economic Area.

In the event of a Transfer of this type, we guarantee that it will be carried out :

• To a country offering an adequate level of protection, i.e. a level of protection equivalent to that required by European regulations;
• Within the framework of standard contractual clauses ;
• Within the framework of internal company rules.

Technical and organizational measures to protect your data

ECO-INNOV is committed to protecting the personal data we collect or process from loss, destruction, alteration, unauthorized access or disclosure.

Accordingly, we implement all appropriate technical and organizational measures, depending on the nature of the data and the risks involved in processing it. These measures must make it possible to preserve the security and confidentiality of your personal data. They may include practices such as restricted access to personal data by persons authorized by virtue of their functions, pseudonymization or encryption.

In addition, our practices and policies and/or physical and/or logical security measures (secure access, authentication procedure, back-up copy, software, etc.) are regularly checked and updated if necessary.

How long we keep your personal data

Your personal data is kept at least for the duration of the processing operations linked to our contractual relationship. Beyond this period, these periods are increased to take into account the rules of legal prescription and legal and regulatory obligations of conservation.
For prospects, the maximum possible retention period of data collected is 3 years, from the last contact between ECO-INNOV and the prospect, unless you ask to delete your data.

For unsuccessful candidates, your data (in particular CV and related information) may be kept for a maximum of 2 years from the last contact, unless you object.

When you exercise your rights, our Data Protection Officer processes your personal data for the purposes of managing your request (title, surname, first name, copy of ID, nature of request, response). This data is kept for a period of 5 years, with the exception of the copy of your identity document – if this is required – which is kept only for the time needed to carry out checks or comply with a legal obligation.
More detailed rules on retention periods are available on a case-by-case basis on request under the right of access (see section ” Your rights regarding your personal data “).

Your rights regarding your personal data

You may exercise your rights at any time by contacting ECO-INNOV at the address given in the paragraph entitled “Your Contacts”.

• Right to object: you may request that your personal data no longer be processed, except where the legal basis for processing is a regulatory obligation or the performance of a contract.
• Right to withdraw your consent: for all processing operations requiring your consent, you have the right to withdraw it at a later date.
• Right of access to your personal data and to the processing: you may ask ECO-INNOV for access to your personal data and for further information about the processing carried out.
• Right of rectification: you may exercise your right of rectification if your personal data is inaccurate or incomplete.
• Right of deletion: you may request the deletion of your personal data at any time. However, such deletion is only possible if the purpose for which the data was collected has been fulfilled, and if the regulatory retention periods allow it.
• Right to restrict processing: you may request the restriction of the processing of your personal data, if you wish to suspend ongoing processing in order to preserve the integrity of this data for a given period until further notice.
• Right to data portability: you can request a copy of the personal data you have previously provided in a structured format, and have it forwarded to the person of your choice. The data will then be transmitted by the data controller to this person in a digital format.
• Right to define the post-mortem fate of your data: you can specify instructions regarding the retention, deletion or communication of your data after your death.

If you are not satisfied with the response you receive, or if no response is forthcoming, you can submit your complaint to the CNIL in accordance with the procedures set out on their website.

When you send us a request to exercise a right, we ask you to specify as precisely as possible the scope of the request, the type of right exercised, the personal data processing concerned, and any other useful information, in order to facilitate the examination of your request. In case of reasonable doubt, you may also be asked to provide proof of your identity.

Exercising your rights is a strictly personal matter and concerns only the applicant on his or her own behalf, or a legal guardian on behalf of a minor or a protected adult such as a person under curatorship or legal guardianship. It cannot be applied for another family member or someone living under the applicant’s roof without proof of a legal mandate entrusted to the applicant by the person concerned, or relevant documentary evidence.

Modification of this Policy

ECO-INNOV may modify this Privacy Policy from time to time. We will ensure that you are informed of any substantial changes (for example, by a special notice on our website).
